It was fairly obvious that, from the start, there was the deliberate intent to commit electoral fraud and on a massive electronic scale.

The signs were there early enough: The insistence of the Commission on Elections (Comelec) commissioners to ensure that Smartmatic would get the P7.3-billion contract for the automated system, to the point of even pressuring its local partner, TIM, to get the partnership sealed again; the hiding from the public, via the Congress, of the many changes in the terms and conditions of the contract; the extra 6,000 auto machines that were not utilized with their whereabouts undisclosed; refusal of the poll body to clean up the voters’ list; Comelec and Smartmatic’s disabling of all the security features; the insistence that the precinct count optical scan (PCOS) machines are “unhackable” and that no cheating can occur, while Smartmatic and Comelec deliberately failed to inform the public that there were ports or consoles in the machines serving as a cheating mode, since such a port could then be used for easy transmission of fake ballots and ERs from any place; the poll body and its tech partner’s refusal to release the source code for review, despite the law saying that the source code should be reviewed by parties and independent IT specialists; the overprint of ballots which has not been accounted for; the sudden changes made in the compact flash (CF) cards a few days before the scheduled polls and the reprogramming of the CF cards plus burner equipment handed to each province and by Comelec and DoST personnel in the provinces; even the early posting of the precinct votes in bulk without Comelec stating where the votes came from and even when the call centers never got them; and many more indications of the body and its partner’s intent to commit large scale electoral fraud.

Finally, the gung-ho automated polls House committee chairman who had conducted an inquiry into this matter admitted that there was systematic cheating, with documentary evidence to boot.

What was strange however, is that despite his admission that cheating was committed, he insists that this was only done on a local level, which really is an illogical conclusion, because systematic cheating done on a local level can also very well be done on a national level. It’s one and the same cheating system.

Just because Noynoy Aquino had a big margin over Joseph Estrada does not automatically translate to no cheating at all. The pattern of cheating in both the local and national levels is pretty evident.

For all one knows, Noynoy may have won the polls, but not with the claimed 15 million votes and not under such dubious polls. One must remember too, that close to 5 million voters’ votes were not read accurately by the machines, plus another 5 million who were disenfranchised — along with the fact that there were pre-shaded ballots, transmissions of the vote which were done much earlier, which means these were fake votes and many more deliberate irregularities besides.

What is clear is that once again, the Filipinos were not the ones who voted for their elected officials but the Comelec and Smartmatic cheats. Even the manual ballot count reflects this cheating.

Despite this discovery of the stealing of the sovereign people’s will by the election cheats, who made a pile of money besides, there went the Comelec, still talking about holding more automated polls in the very near future, buying the Smartmatic machines, although saying too that the next time, there would be more focus on the security angle.

What rubbish these commissioners spew. They must have known, from the start, given the fact that SysTest itself did not give the source code a clean bill of health, and deliberately disabling all the safety features from the start, would open the elections to massive cheating.

Comelec and Smartmatic had IT specialists in their areas. It is impossible that none of their IT experts hired by the partners realized early on, in checking on the PCOS, that it had an open console that could be used to transmit poll results from anywhere in the country, apart from which, the PCOS could be reset to zero, be refed, rescan ballots and everything fraudulent besides. None of them saw this and reported this?

What all this can mean is that from the start, there was that wide scale conspiracy to commit automated electoral fraud.

Namfrel: No to 2013 automated polls if system not fixed

An election watchdog on Friday said it would not recommend automating the 2013 local polls unless the poll body fixes the system used in the May 10 elections.

“Under the current system, I wouldn’t recommend it. If they can address the weaknesses, particularly putting more safeguards, greater transparency, auditability and traceability, then we can go ahead with automated elections in 2013,” National Citizens’ Movement for Free Elections (Namfrel) chairperson Jose Cuisia Jr. told GMANews.TV in an interview on Friday.

The poll watchdog’s recommendation echoed the report released this week by House Committee on Suffrage and Electoral Reforms, headed by Makati City Rep. Teodoro Locsin Jr., saying that electoral fraud took place during the recent national and local elections.

The same report discouraged the Commission on Elections (Comelec) from using the May 10 automated system in the 2013 elections. Cuisia said the poll body has “more than enough time” to find solutions to problems encountered during the previous elections before proceeding with automation in 2013.

Namfrel presented 15 “concerns” that have remained “unadressed” two months after the May 10 automated polls, it said in a press conference in Makati City. These “concerns” include the removal of the digital signatures, the erroneous date and time logs on the precinct count optical scan (PCOS) machines, as well as the lack of a “detailed inventory” of all equipment used during the May 10 polls.

“The preoccupation with new technology and speedy counting to impress the public came at the expense of greater transparency and accountability of the system,” Cuisia said during the press conference. The Namfrel chairperson likewise gave several recommendations to the Comelec to address these problems, which include publicly disclosing results of the random manual audit, as well as a full report of Comelec expenditures during the past polls.

“We give these observations and thoughts in the spirit and hope that improvements can be made in future systems and elections, which will hopefully mitigate the types of problems that we experienced in May,” he said. The group’s recommendations will be forwarded to the Joint Congressional Committee on Poll Automation and to the Comelec, according to Cuisia. The Comelec denied Namfrel accreditation to be the poll body’s official citizen arm during the May 10 elections, and instead gave the responsibility to the Parish Pastoral Council for Responsible Voting (PPCRV), which performed random manual audits during the previous polls. — LBG, RJAB Jr., GMANews.TV

Comelec urged to fix problems in automated election system

MANILA, Philippines—The National Citizens’ Movement for Free Elections (Namfrel) has cautioned the Commission on Elections against its plan to conduct automated elections in 2013 pending “unresolved” issues in the first computerized balloting last May 10.

Namfrel Secretary-General Eric Alvia said the Comelec should first fix the procedural and technical glitches in the May 10 automated elections before it pushes ahead with preparations for the mid-term national and local elections on May 2013.

Comelec officials said it was likely that the 2013 elections would use a voting and canvassing technology similar to what was used in the last elections. The system was supplied by Smartmatic TIM Corp., which entered a P7.2-billion deal with the Comelec to conduct the country’s first nationwide computerized balloting.

Although the poll watchdog acknowledged that the 2010 elections were fast and generally accurate, the automated election system used by the Comelec and Smartmatic TIM “ is in serious need of review and remedial measures before it is to be used for future elections.”

The organization cited the wrong time and date stamps on the election returns, the lack of digital signatures, and the incomplete inventory of the voting machines and the compact flash cards. These deficiencies, the poll watchdog said, threw doubts on the integrity of the results.

Namfrel, Alvia said, supports automated polls, but it should be free from the technical problems that plagued the last elections.

Namfrel, in its report issued Friday, said the May 10 polls, which employed vote-scanning and counting machines and computerized canvassing system nationwide, was not as transparent and secure as the Comelec and its provider, Smartmatic TIM Corp. claimed it to be.

Namfrel said they received reports from their field officials that some Precinct Count Optical Scan print outs showed more ballots than what was actually inside the ballot box.

Furthermore, the random manual audit of certain precincts showed that the degree of variance was less than the required 99.995-percent accuracy.

In the audit of a precinct cluster at the University of the Philippines Integrated School, there were differences in the manual and machine count for the positions of president, vice-president, and representative, the Namfrel report said.

Teachers who audited the ballots counted 689 votes for president, but the voting machine tallied 695. The manual count for vice-president was 695, one more vote than the machine tally, Namfrel said.

Overall, the machine had a 99.35-percent accuracy, which is below the required 99.995 percent, Namfrel said.

The Parish Pastoral Council for Responsible Voting, the Comelec’s citizen’s arm, supervised the audit of 1,145 precincts.

The audit was aimed at determining the accuracy of the results from the Precinct Count Optical Scanners, which were used for the first time in Philippine elections.

Namfrel said the poll agency should release the complete report of the RMA to lay to rest questions on the integrity and accuracy of the PCOS count.

Comelec rejects Roxas demand for manual recount

MANILA, Philippines –The request of defeated vice-presidential candidate Manuel “Mar” Roxas to manually recount the ballots is impossible, a member of the Commission on Elections said Friday.

Election Commissioner Gregorio Larrazabal said the manual appreciation of ballots, the process used in protests under the manual election system, has no place in the age of automated elections.

He noted that the guidelines for the revision of votes state that ballots would be “re-scanned” by the vote-counting machine.
Ballot images stored in the compact flash cards will be used in lieu of ballots that may have been destroyed in storage.

Last Wednesday, Comelec Chairman Jose Melo said ballots under electoral protest would be re-counted by feeding them into the Precinct Count Optical Scan (PCOS) machine. The recount should employ the PCOS machines so that it would not be “in conflict” with the official tallies generated by the automated election system.
