NAVAL, Biliran, Philippines – It is a joyful Christmas for six elected municipal mayors in the Eastern Visayas province of Biliran after their victories were upheld by the Supreme Court and the Commission on Elections (Comelec)’s Central Office.
The Supreme Court en banc confirmed the victory of first termer Caibiran, Biliran Mayor Eulalio Maderazo even as it dismissed with finality a petition to nullify Maderazon’s count in the polls filed by losing candidate Floresca Sia Delante.
Assistant Clerk of Court Felipa F. Anama of the Supreme Court, in a notice dated September 8, 2010 which was obtained this week by this writer, said the Supreme Court dismissed the petition filed by Delante against Presiding Judge Bienvenido M. Montalla of the Regional Trial Court 37, Caibiran and members of the Municipal Board of Canvassers Deonilo Pantas, Marlyn Gervacio and Loreto Serdana, and Mayor-elect Maderazo for “error in the choice or mode of appeal.”
Meanwhile, the COMELEC’s Second Division also dismissed the election complaint of losing mayoralty candidate Rogelio H. Yu against Mayor Enrico Uyvico after the former was found to have paid P1,600.00 only instead of the P3,600 appeal fee with the poll body as required by Section 3, Rule 40 of the COMELEC’s Rules of Procedure, as amended by COMELEC Resolution No.02-0130,s eries of 2002.
