Utilizing, developing, operating and/or managing should be the right term to be used in connection with the Geothermal Energy potential of Biliran. It should not be seen as a threat.

The real exploitation should not be connected with the Geothermal Energy but rather to the Sulfur mining in Pulang Yuta in Caibiran. It is exploitation in the sense that there were anomalies involve. Exploitation of the Sulfur in Pulang Yuta is the real threat – threat to the environment, threat to the mountain in that area.

It is not enough trumpeting that the mining operation was stopped because of a vigilant village. It is not enough that the permit was invalidated. What’s more important here is to prosecute those officials who were involved in the anomaly. These officials should be punished.

I totally agree with you on that. Not only the officials but the company who mined the area. The officials of those company should be held liable for the rape of that mountain. For the people, RISE BILIRAN, MABUHAY BILIRAN!

the real culprit here is not the "company" but the PROVINCIAL GOVERNOR & HIS COHOOTS who authorized the raping of our natural resources, HOWEVER, if the "COMPANY" is a dummy corporation and it belongs to one of the OFFICIALS OF OUR PROVINCE, then, by all means, ALL OF THEM ARE TO BE PROSECUTED!!!! THEY are only interested in acquring ill-gotten wealth, in any shape or form!!! ...THIS IS VERY SICKENING!!!

I agree with you hummingbird. But as far as I know, the provincial government's participation is with regards to the granting of the permit only. The company is owned by a certain Ranulfo Kuizon from the southern part of Leyte. A complaint should be filed against this company at the DENR because what they were issued there was for small-scale mining but what they actually did was to deploy machines that's why concerned citiznes were alarmed. DENR should do something about this, especially their EMB unit. The EMB issued the mining claim for this site. What DENR lacks is the monitoring component. Without the people's vigilance, this could have gone on unnoticed.

madlangbayan... the Governor has the capacity to reject it if he WANTED TO, but he DID NOT!!! THE BUCK SHOULD HAVE STOPPED AT HIS DESK!!!!

Let's make it clear, do you mean it's the Governor's fault? If so, how could we let him answer for this dereliction of duty? How could we prosecute this act?

Look, how could the people of Biliran rise as you used to say if the perpetrators of the exploitation of the sulfur reserved go unpunished?

Sorry late reply, but let me dissect it as logically and reasonably as I can but let me remind you I am not a lawyer. The Borrinaga report or article posted in this website says under a subtitle "bribery, dummy", "A reliable source had revealed that the sulfur mining permit in Caibiran was worth P2.5 to P3-Million in goodwill money given to the signatory. However, this alleged bribery was denied to have occurred by Sofronio Dacillo, Jr., environmental management specialist of the provincial government, who in turn asked if the information came from a priest." In short it alleges that there was an exchange of bribe money. CAN WE SUE? Yes of course, but who received it and who witnessed it, we never know. Not unless the people who supposedly knew it, come out, no charges can be filed against the officials involved.
The report also says, On May 6, 2008, the Biliran provincial government through Gov. Rogelio J. Espina issued Small-Scale Mining Permit No. 2008-001 to one Ranulfo F. Kuizon, for the extraction of sulfur in Sitio Pulang Yuta in Barangay Cabibihan, Caibiran. The governor issued, let me state again, issued a permit for SMALL SCALE MINING. which is not against the law per se because in our Mining Act, small scale mining is encouraged and the governor can issue a permit. What was lacking, to my mind, was the mechanism to monitor the project. If not for the people's vigilance, we would have woken up the next day, to a tragedy in the making. And perhaps too, greed on the part of the officials concerned. There must have been a tripartite body created to undertake environmental monitoring and compliance of the project. In this instance, the DENR thru EMB and the provincial government failed. On the other hand, the mining company abused the permit granted and really exploited the environment. CAN WE SUE? Yes, i think for violation of RA 6713 and RA 3019 specifically section 3 paragraph e which states:(e) Causing any undue injury to any party, including the Government, or giving any private party any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial functions through manifest partiality, evident bad faith or gross inexcusable negligence. This provision shall apply to officers and employees of offices or government corporations charged with the grant of licenses or permits or other concessions.
Well as I have said I am not a lawyer, but any citizen can file a complaint, the hard part is the gathering of eveidence prior to the filing of a case. Hope you're enlightened.

Allow me to interact with your discussion.

I am enlightened and am sure KillerQueen will also be enlightened by your explanation as to the fact that it will be a great burden to gather evidence that there was bribery. Am sure would-be whistle-blower will not come out especially that whistle-blowers nowadays were being persecuted for telling the truth. Jun Lozada, Acsa Ramirez and many others who dared to come out and tell the truth were persecuted. I doubt if there were others who would dare to come out.

Now with the Mining Act, in my own understanding, the small scale mining is encourage PROVIDED there was a body that would monitor the safety of the mining personnel and it’s impact to the environment among others. Am not well-versed with the Mining Act and the RA’s but in my own understanding, it is not just enough to be complacent and say that small-scale mining is encourage. Yes, it is encourage but there must be safety nets installed before, during and after the exploitation of the sulfur reserved. For example, before the mining operation there must be: 1) a thorough study on the it’s (mining) impact to the environment; 2) there must be a thorough study to what extent the mining will be allowed. During the exploitation, there must be a third party or an organization that would monitor the operation, so on so forth. I wonder if the governor who, as what you said, issued the permit, was aware of these. I also wonder if there is a DENR/EMB in Biliran, if these agency exist, then as a taxpayer I demand the resignation of the personnel in this agency. Let me quote you, “ In this instance, the DENR thru EMB and the provincial government failed.” Indeed, they failed in their duties. Indeed, this is the real exploitation. Indeed, this is the real threat to the mountain and not the plan to develop the Geothermal potential of the Province.
