TACLOBAN CITY-The National Bureau of Investigation regional office here is set to halt its investigation in connection with the ambush that was staged against the group of Charlie Chong sometime last month.
NBI regional director lawyer Antonio Pagatpat said once the Department of Justice will find “prima facie evidence” against the five respondents in the double murder, frustrated murder and grave threats cases, automatically he would order a stop on the conduct of investigation which they started immediately after the June 7 incident.
Based on legal procedure, you cannot file the same case at the same court, but according to Pagatpat, if the prosecutions office will dismiss the case against the respondents because lack of merit, that would be the time that the NBI can now file its another case and present other evidences and witnesses they have gathered from their investigation.
“We cannot file any case as of this moment in connection with the ambush, We’ll just wait and see whatever decision will come out in the preliminary investigation and that we can assure them we can file our case,“ Pagatpat said.
Charlie Chong, the father of Biliran Rep. Glen Chong, has earlier filed the three cases against former Biliran Congressman Gerardo Espina Sr., former Biliran PNP provincial director Senior Supt. Alfredo Sabornido, two members of the CID and one Biliran policeman.
The group of Chong, to ensure that the case that have earlier filed before the provincial prosecutions office in Naval will not be influenced by any person in power, has asked the Regional State Prosecutor’s Office to transfer the venue of preliminary investigation.
But it was Espina a week ago who instead filed his motion before the DOJ central office in Manila to transfer the preliminary investigation, saying that he is determined that no one can influence from their side and the side of the complainant the officials of the DOJ.
“I think we can expect a fair investigation…,” Espina stressed.
The NBI has earlier said that they were about to complete the process of their investigation when the complainant and the PNP through evidences and witnesses had filed the said criminal charges.
